issues with new laptop... the computer itself or software/drivers?

i have an hp dv5-1044 (future shop exclusive in canada) with the 32 bit vista. im having a few issues. ive had it for a week now and 3 times theres been issues with the volume controls. its like a touchsensitive thing and i'll push it and nothing will happen. then, like a minute later it'll start clicking like its just realizing i was touching the button before but i wont stop. its just keeps clicking and clicking and not adjusting the volume at all. i have to put the pc into hibernate mode to get it to return to normal. theres even been one time that i couldnt adjust the volume by the icon in the lower left hand corner (the pop up wouldnt come up at all). the other issue i have is with the CyberLink YouCam software that came preinstalled for the webcam. ive opened it 3 times and 2/3 times ive opened it, its frozen on me/
